Privacy Notice for This Morning App
Your privacy is our priority
Your data is important. It’s important to us, and we understand that it’s important to you. ITV is committed to safeguarding your information in line with the latest data protection and privacy laws. We also want to be transparent about what information we collect about you, how we use it, and how you can control what we do with this information.
About this notice
This privacy notice covers all versions of the This Morning app (collectively, the “App”) that are controlled by us and made available for mobile devices via iTunes or the Google Play Store. In this notice, “ITV”, “we”, “us” and “our” means ITV Consumer Limited (except where these terms are used in connection with “Get Involved”, in which case they mean ITV Studios Limited).
Any personal information you supply to us via the App (and by other means) will be treated in accordance with this privacy notice. Our general privacy notice at itv.com/privacy also applies.
What this notice doesn’t cover
This privacy notice does not cover companies, services or applications that we don’t own or control, or people that we don’t employ or manage. This includes any third party websites, pages, applications/widgets or other services that we link to or offer via the App (e.g. if you click on an advert and it takes you to an advertiser website) including the ITV Shop, which is operated by Monterosa Productions Limited. You should instead refer to the Shop privacy notice in relation to your use of the Shop which is found at the bottom of the ITV Shop page. The App includes functionality that enables users to enter ITV competitions. This privacy notice does not cover the “Win” section of the App or your participation in any ITV competitions via the App. You should instead refer to our general privacy notice at itv.com/privacy.
What information do we collect?
We may collect the following information in the provision of the App to you:
how you access the App - for example your internet protocol (IP) address, device type and identifier, and operating system; and
information about your use of and interaction with the App.
Depending on your activity on the App, we may also collect the following data:
a unique identifier which represents your device to enable us to avoid duplication of your responses to polls and other content within the App; and
information you disclose to us when you contact us with an enquiry, request or feedback (e.g. via the ‘Get Involved’ function of the App).
How will we use your information?
We and our authorised third parties will only process your personal information where we have legal grounds to do so. Please see the table below for the legal grounds for processing different types of information:

When you contact us with feedback, we have a legitimate interest to pass your feedback on to the relevant team within ITV if appropriate. We also have a legitimate interest in monitoring our communications to improve our customer services.

Legitimate interests
Where we process your personal information on the basis of legitimate interest for analytics we are referring to our legitimate interest in understanding how people are using the App; to improve the App and to understand when content and advertising is viewed.
Affiliate links
Sometimes when we recommend a product in the App, we use an affiliate link to earn income from purchases made by App users who click on the link and go on to buy the product. These links do not affect our editorial content or decisions to recommend products, nor do they affect the price of any products. We will make clear to you which links are affiliate links.
We use a company called Skimlinks to provide these links. This section explains how Skimlinks operates, what information they collect about you and how they use it. What is Skimlinks?
Skimlinks’ service works by creating/tagging links within content which, if clicked, take you to a website of a supplier of goods and/or services (a “Merchant”) where the products and/or services can be purchased. If you then buy something as a result of clicking on these links, we are paid a referral fee by the Merchant through Skimlinks. This referral fee does not come out of your pocket, nor does it affect the price you pay or the experience you have on our App or on the Merchant’s site. What information does Skimlinks collect about you through the affiliate links and how does it use this information?
If you click on an affiliate link, Skimlinks will collect the following data about you and process it on the basis of the following legitimate interests:
Skimlinks will collect and store your IP addresses, from which it can determine your approximate geographical location (e.g. country or region). Skimlinks needs this information to optimize the links that are created/monetized to suit your geography, and to provide aggregate reporting to us and Merchants on the location of users clicking on the affiliate links. Skimlinks also uses IP addresses to reduce fraud and identify non-human browsing patterns
Skimlinks will collect and store information about the device you use to access the App, such as the browser type, browser version, and type of device. This helps Skimlinks to ensure that they can diagnose and fix browser compatibility issues more swiftly, optimize their service to suit the preferred browsing environments, and provide aggregate reporting to us and Merchants
Skimlinks will collect and store non-identifiable information, using cookies and device identifiers, about the App and other websites within their network that you visit, which of their links you click on, and whether you make a purchase. This enables Skimlinks to provide you with relevant and useful links and advertising to products and/or services in which you are likely to be interested, and to Merchants and advertisers from whom you are likely to want to buy. As part of the information available in standard web serving logs, Skimlinks also stores information about the referrer, i.e. the website page from which you linked to the App or the Merchant site
To provide Merchants and us with the affiliate link services, Skimlinks collects information on visits and sales on websites using the affiliate links, including but not limited to order value, products bought, and order identifiers. These are used to help Merchants and us to make better marketing and content creation decisions
At no time does Skimlinks know who you are, nor does Skimlinks make any attempt to try and identify you.
Skimlinks retains data it collects from you for up to three years. After that it will either delete or anonymise it or, if that is not possible (for example, because your personal data has been stored in backup archives), then it will securely store your data and isolate it from any further processing until deletion is possible.

Skimlinks Cookies
Skimlinks uses cookies to collect the information it needs to optimise the affiliate links it monetizes/creates, and to improve its services. It synchronises cookie identifiers with third parties in order to enrich its service and offer personalized experiences across the web. As you browse websites which include Skimlinks’ affiliate links, cookies will be placed on your device so that Skimlinks can understand what you are interested in. In order for the referral fees and commissions to be paid by Merchants to us, Skimlinks works with affiliate networks and other ad networks that manage the relationships between Skimlinks and the Merchants. As set out above, if you click on a Skimlinks’ affiliate link you will be assigned a unique identifier number.
When a User clicks on a link created by a Tool, Skimlinks attaches the User’s unique identifier number so it passes to the appropriate affiliate network for the purpose of tracking whether that User makes a purchase on the Merchant website they visit. Note that at no time do we pass any Personal Information, nor make any attempt to determine the actual identity of an individual User; all information is completely anonymous and used only for the purposes of optimizing the service provided to the User. The affiliate and ad networks that work with Skimlinks also use their own cookies in order to track if a sale has occurred, as most of these parties will only pay Publishers when a referral has been successful, i.e. a sale was completed. We do not have control over or access to these cookies and they are dropped by the affiliate and ad networks via our Skimlinks Enabled Sites.
How can I disable Skimlinks cookies?
If you no longer want Skimlinks to store data about the websites you visit, the links you click and the Merchants you buy from, you can simply opt-out here. This will mean that Skimlinks will not drop Skimlinks cookies when you browse the App or the websites of Merchants or other companies which use Skimlinks’ services.
Please note: This opt-out facility relies on a cookie being set on your browser. By visiting the link above, you acknowledge that Skimlinks will be setting and maintaining the cookie on your browser in order to recognise you as an opted-out visitor. You must opt-out again if you clear that cookie from your browser (see allaboutcookies.org for more information), use a different internet browser, or use a different computer to access the internet.
If you opt-out of Skimlinks cookies, Skimlinks will still operate on pages that you visit, and there will still be Skimlinks affiliate links in some of the content on the App. Skimlinks just won’t optimise those links based on your preferences and behaviours, nor will Skimlinks associate the websites you visit and shop from to a specific cookie.
Will we send you marketing messages?
You may be asked if you would like to receive push notifications. You can turn these off at any time by adjusting the settings on your device.

Identifiers
If you download the App on a mobile device with a Google Android or Apple iOS operating system then the App may check the status of user identifiers provided by that operating system or collect certain information submitted by you when voting. We will pass on that identifier and its status to permitted third parties so that you can vote in polls and for analytics purposes.
In what circumstances do we share your information?
We do need to share your personal data with third parties in some circumstances. This will only take place in accordance with the applicable law and for the purposes set out below. We pass information about you to other parties as follows:
to our outsourced service providers or suppliers to facilitate the provision of our products or services to our users, for example, disclosure to our polling provider in order to allow you to participate in, and for ITV to collect votes in relation to polls;
to third party service providers and consultants in order to protect the security or integrity of our business, databases and systems and for business continuity reasons, including any third-party service provider used to screen communications for legal and regulatory compliance purposes;
to another legal entity, on a temporary or permanent basis, for the purposes of a joint venture, collaboration, financing, sale, merger, reorganisation, change of legal form, dissolution or similar event. In the case of a merger or sale, your personal data will be permanently transferred to a successor company;
to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence, unlawful activity or suspected breach of the App Terms and/or the breach of other terms and conditions or otherwise where required by law or where we suspect harm or potential harm to others. We will cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or location of or any other information about anyone breaching any relevant terms and conditions or otherwise for the prevention or detection of crime or the apprehension or prosecution of offenders; and/or
to any other third party where you have provided your consent.
We also share your personal information with other parts of the ITV group of companies.
We do this to:
provide a more personalised experience across our different products and services ;
provide and/or manage cross or intergroup products and services; and/or
provide other services and products you request or to promote those which might be of interest to you.

Service providers based outside Europe
In providing our services to you we may use third party companies to perform or enable us to provide some of the functions of our services. Some of these companies may be located, or have servers that are located, outside the European Economic Area. Third Party Links
The App may contain links to other websites which are outside our control and are not covered by this privacy notice. If you access other websites using the links provided, the operators of these websites may collect information from you (including by using cookies) in accordance with their own cookie policy and / or privacy notice, which may differ from ours.
Any personal data which you submit in accessing the App via the Apple and/or Android device app store providers (including without limitation Google Play, Samsung App store or other Android store) is held by the app store provider under their privacy notice and cookie policy.
What are your rights?
Any personal information you supply will be treated in accordance with applicable data protection laws including the Data Protection Act 2018 and the UK General Data Protection Regulation (the “GDPR”) and any other applicable or superseding legislation. We are committed to delivering the rights that individuals are entitled to under data protection laws in the UK. These are:
the right to request a copy of the personal information we hold about you. To do this, please contact us at myprivacy@itv.com making clear that you are requesting a copy of your personal information and including full details of what you require. You may also be required to submit proof of your identity.
the right to object to your personal information being used for direct marketing. Where required we will ensure we obtain your consent before undertaking marketing and you will have the ability to opt out.
the right to object to your personal information being processed where the legal basis for the processing is our own legitimate interests as a business (see ‘How will we use your information?’ section above). We will comply with such a request unless there is a lawful reason for not doing so, such as when we need to continue to process your information to defend a legal claim or if this information is necessary for the ongoing provision of our products and services.
the right to rectification. You may request that we correct any inaccurate and/or complete any incomplete personal information.
the right to withdraw consent. Where we are processing your personal information on the basis that you have given us your consent to do so, you may withdraw your consent at any time. Please note that if you withdraw your consent, you may not be able to benefit from certain service features for which the processing of your personal information is essential.
the right of erasure. You may request that we erase your personal information and we will comply, unless there is a lawful reason for not doing so. For example, there may be an overriding legitimate ground for retaining your personal information
the right to data portability. In certain circumstances, you may request that we provide your personal information to you in a structured, commonly used and machine readable format and have it transferred to another provider of the same or similar services to us. Where this right is applicable, we will comply with such transfer as far as it is technically feasible. the right to lodge a complaint with the supervisory authority. We suggest that you contact us about any questions or if you have a complaint in relation to how we process your personal information.
