Should talent affect jail sentencing?

There was outrage after an Oxford University medical student avoided prison after stabbing her boyfriend in a drunken attack.

In the controversial sentencing decision, the judge described Lavinia Woodward as 'extraordinary' and said time in prison would prevent her from fulfilling her dreams of becoming a surgeon.

Was the judge right to spare her from jail time?

Earlier we were joined by retired judge Lindsey Kushner, who says putting someone behind bars is a difficult decision to make.

Sitting in judgement was Julia Hartley-Brewer, who thinks Lavinia should be serving a sentence. Julia flipped the narrative and asked if a male of a different race had committed the same crime would the outcome have been the same?

She said: “If you’re clever, if you’re middle class, if you’ve got a good job ahead of you, it’s alright to go around stabbing people.”
